1. Introduction
Welcome to EquitableAccessCenter ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at equitableaccesscenter.sbs (the "Service") operated by EquitableAccessCenter.
By reserving a yacht charter or using our Service, you consent to these Terms. Should you not agree with any portion of these terms, you must not utilize the Service.
2. Service Overview
EquitableAccessCenter offers exceptional yacht charter services, which include, but are not limited to:
- Rental of yachts for the day
- Evening boat trips
- Business getaways
- Custom celebrations
- Extended yacht voyages
Availability of services is contingent on weather conditions and may change. We retain the discretion to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For booking a charter, certain requirements must be fulfilled:
- A minimum age of 18 years
- The provision of precise and comprehensive details
- Payment of a deposit as outlined in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is officially confirmed following the receipt of payment and our issuance of written confirmation. We reserve the right to deny service at our discretion.
3.3 Availability
Charters are offered subject to the availability of vessels and appropriate weather conditions. We will endeavor to accommodate your preferred dates and timings as best as possible.
4. Payment Terms
4.1 Pricing
All price listings are in € and encompass any applicable taxes unless indicated differently. Prices may be altered without prior notification.
4.2 Payment Schedule
- Deposit: A payment of 50% of the total charter cost at the time of reservation
- Remaining Balance: Due 48 hours before the charter begins
- Incidental expenses (if applicable): Payable upon the charter's conclusion
4.3 Payment Methods
We accept several major credit cards, bank wire transfers, and certified cheques. Processing of payments is carried out through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: A full refund with deduction of processing fees
- Between 24 to 72 hours notice before departure: A refund of 50%
- With less than 24 hours notice before departure: No refund provided
5.2 Weather Cancellations
In the instance of weather conditions being unfavourable as judged by our captain, we will propose to:
- Reschedule your charter to another available date with no extra costs
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical issues arise with your designated vessel, we will strive to supply a comparable alternative. If no alternative can be found, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Comply with all instructions from the crew members
- Utilize the provided safety equipment as needed
- Inform us of any health conditions that might influence their safety on board
- Stay within the assigned areas on the yacht
6.2 Prohibited Items
The following items are not permitted on the yacht:
- Glass containers
- Illegal substances
- Weapons of any kind
- Excessive amounts of beverages (beyond reasonable personal consumption)
- Animals (unless given prior approval)
6.3 Conduct
Passengers are expected to behave in a considerate and respectful manner. We maintain the right to conclude a charter prematurely without a refund if a passenger's behavior presents a threat to safety or hinders the enjoyment for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the value paid for your charter. We are not accountable for:
- Personal injuries caused by the negligence of the passengers
- The loss of or damage to personal property
- Secondary, subsequent, or punitive losses
- Delays resulting from weather or events beyond our management
7.2 Insurance Coverage
We uphold comprehensive marine insurance covering our fleet and operations. Clients are encouraged to secure their own travel and personal insurance.
7.3 Assumption of Risk
By participating in a yacht charter, you recognize that ocean-based activities carry inherent dangers and you accept responsibility for your safety and security.
8. Modifications and Itinerary Changes
We hold the authority to adjust itineraries, pathways, or timetables in response to weather conditions, security considerations, or operational demands. All efforts will be made to facilitate equivalent alternative arrangements.
9. Force Majeure
We shall not be held accountable for any hold-ups, cancellations, or service changes brought about by events outside our control, which may include, but are not limited to:
- Extreme weather situations
- Natural calamities
- Legal mandates
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is processed as per our Privacy Policy. By engaging with our services, you consent to our collection and usage of your data in line with the Privacy Policy.
11. Intellectual Property
All contents displayed on our site, such as texts, visuals, emblems, and photographs, are protected by copyright and trademark regulations. Unauthorized reproduction, dissemination, or creation of derivative material is not permitted without our explicit permission.
12. Governing Law
These Terms are enforced by the laws relevant in Germany. Any disputes will be settled in the courts situated in Hamburg, Germany.
13. Changes to Terms
We reserve the prerogative to amend these Terms at any given time. Any revisions will be communicated on our site with a notification of the modification date. Persisting to use our services signifies recognition of the newly amended terms.
